BACKGROUND / EXTRA RELEASE

This Background / Extra Release ("Release") is entered into as of [effective date] by and between [producer / company] and [background performer].

  1. 1. Grant of Rights

    In connection with the production presently entitled [production name] ([project description]), [background performer] ("Performer") grants [producer / company] ("Company") the irrevocable, perpetual right to photograph, film, record, and use Performer's appearance, likeness, image, and voice as a background/atmosphere performer, and to reproduce, edit, exhibit, distribute, and otherwise exploit the same in any and all media now known or hereafter devised, throughout the universe, in perpetuity, including for advertising and promotion.

  2. 2. Consideration

    In consideration of [consideration], the receipt and sufficiency of which are hereby acknowledged, Performer grants the rights set forth herein.

  3. 3. No Guarantee of Use

    Company is under no obligation to use Performer's appearance and may edit, alter, or omit it in its sole discretion. No compensation beyond the consideration stated herein shall be due whether or not Performer's appearance is included.

  4. 4. Ownership

    All footage, recordings, and materials embodying Performer's appearance shall be the sole and exclusive property of Company, which shall own all rights therein, including all copyrights, and Performer shall have no right, title, or interest therein.

  5. 5. Release & Waiver

    Performer releases and discharges Company and its licensees, successors, and assigns from any and all claims arising out of the use of the materials described herein, including claims for invasion of privacy, right of publicity, defamation, or any similar claim, and waives any right to inspect or approve the finished materials or the use to which they may be applied.

  6. 6. Representations & Warranties

    Performer represents and warrants that Performer is at least eighteen (18) years of age and is free to grant the rights set forth herein.

  8. 8. Governing Law

    This Release shall be governed by and construed under the laws of the State of California, without regard to its conflict-of-laws principles.
